Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and The Answer AI, operating as mediaXtreme LLC ("Company," "we," "us," or "our"), the creators and operators of the TITILISA platform available at titilisa.com ("Platform" or "Service").

By creating an account, accessing, or using any portion of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform and delete your account.

These Terms apply to all visitors, users, and others who access or use the Service.

Eligibility & Account

To use TITILISA, you must be at least 18 years of age and capable of forming a binding contract under the laws of your jurisdiction. By registering, you represent and warrant that all information you provide is accurate, current, and complete.

• You are responsible for maintaining the confidentiality of your account credentials.
• You may not share, sell, or transfer your account to any third party.
• You are solely responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

We reserve the right to refuse registration, cancel accounts, or remove content at our sole discretion.

AI Input/Output Ownership

TITILISA operates a clear and deliberate intellectual property framework distinguishing between your creative contributions and the underlying technology that powers them.

Specifically:

• User Ownership: You retain all rights to the content outputs generated by the Platform when acting on your behalf, including videos, captions, hashtag sets, and posting schedules derived from your instructions.
• Company Ownership: The Answer AI retains exclusive ownership of the TITILISA engine, including all underlying machine learning models, linguistic analysis algorithms, Voice DNA cloning architecture, scheduling infrastructure, posting automation logic, and the TITILISA brand.
• License to Operate: By using the Service, you grant The Answer AI a limited, revocable, non-exclusive license to process, transform, and distribute your input content solely for the purpose of delivering the Service to you. This license terminates when you delete your account or cancel your subscription.
• No Reverse Engineering: You may not attempt to extract, reproduce, or replicate any part of the underlying algorithms, models, or engine architecture through any means.

Prohibited Content & Conduct

The Platform must not be used to create, distribute, schedule, or amplify any of the following categories of content. Violation of this section may result in immediate account termination, reporting to relevant authorities, and potential legal action.

• Deepfakes & Synthetic Deception: You may not use the Platform to create, distribute, or promote non-consensual deepfake media depicting real individuals — including AI-generated voice cloning of other persons without their explicit written consent.
• Hate Speech & Discrimination: Content that promotes, glorifies, or incites violence or discrimination against any individual or group on the basis of race, ethnicity, religion, gender, sexual orientation, disability, nationality, or any other protected characteristic is strictly prohibited.
• Disinformation & Misinformation: You may not use the Platform to generate, amplify, or systematically distribute knowingly false information intended to deceive the public, manipulate elections, or undermine public health guidance.
• Illegal Activity: Content promoting, facilitating, or advertising illegal goods, services, or activities, including but not limited to fraud, money laundering, child exploitation, and unauthorized surveillance.
• Spam & Coordinated Inauthentic Behavior: Automated posting designed to simulate organic activity in a deceptive or manipulative manner beyond the bounds of legitimate personal content automation.
• Intellectual Property Violations: Uploading or distributing content for which you do not hold the necessary rights, licenses, or permissions.

We reserve the right to review, remove, or flag content at our discretion and cooperate with law enforcement where required.

Third-Party API Dependency

TITILISA integrates with a range of third-party social media platforms and API providers to deliver its core posting and distribution functionality. These integrations include, but are not limited to, Meta (Instagram, Facebook), TikTok, YouTube, Pinterest, and Zernio.

You acknowledge and agree that:

• Third-party platforms may unilaterally change, restrict, or revoke API access at any time without notice to TITILISA or to you.
• Features dependent on specific third-party APIs may be temporarily or permanently unavailable due to decisions made by those platforms.
• We will make commercially reasonable efforts to restore functionality when third-party APIs are modified, but we make no guarantee of continuity of any specific integration.
• Subscription fees are not automatically refunded due to third-party API outages unless the disruption meets the criteria outlined in our Refund Policy.
• You are independently responsible for complying with the terms of service of all third-party platforms to which you post content through TITILISA.

Telnyx Identity Verification

To ensure the security of your account and comply with applicable telecommunications regulations, TITILISA uses Telnyx to verify your identity via a mobile device during account registration and at other security checkpoints.

• Device Binding: Your account is associated with the mobile number verified through Telnyx at registration. Using your account from a different primary device may trigger re-verification or temporary lockout.
• One Account Per Device: Each verified mobile number may be associated with only one TITILISA account. Creating multiple accounts using the same mobile number or through artificial verification bypass is prohibited.
• Data Sharing: Your mobile number and device verification data are shared with Telnyx as part of the verification process. This sharing is governed by our Privacy Policy and Telnyx's own privacy documentation.
• Device Change Process: If you change your primary mobile device, you must contact support to initiate a device re-binding process. Failure to do so may result in account inaccessibility.
• No Liability for Telnyx Outages: We are not liable for verification delays or failures caused by Telnyx service disruptions. We will endeavor to provide alternative verification routes in the event of extended Telnyx downtime.

Credits & Billing

TITILISA operates on a credit and subscription model. Credits are consumed each time the Platform calls third-party APIs, generates AI content, or executes a distribution action on your behalf.

• Credits are non-transferable, have no cash value, and expire upon account termination.
• Subscription fees are billed in advance on a monthly or annual cycle as selected at checkout.
• All pricing is displayed in USD. Applicable taxes are your responsibility and may be added at checkout based on your jurisdiction.
• We reserve the right to modify pricing with 30 days' advance notice to active subscribers.

Termination & Suspension

We reserve the right to suspend or terminate your access to the Platform, at our sole discretion, with or without prior notice, for any of the following reasons:

• Violation of these Terms or any applicable law or regulation.
• Conduct that we reasonably believe poses a risk to other users, third parties, or the integrity of the Platform.
• Non-payment of fees or chargebacks.
• Requests from law enforcement or regulatory authorities.
• Extended periods of account inactivity.

You may terminate your account at any time through the account settings dashboard. Upon termination, your license to use the Service ends immediately. We will retain data for the period required by our Privacy Policy and applicable law.

Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ANSWER AI AND MEDIAXTRE ME LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR REPUTATIONAL HARM, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (i) the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim, or (ii) USD $100.

Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body in your jurisdiction, except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

You waive any right to participate in a class action lawsuit or class-wide arbitration against The Answer AI or mediaXtreme LLC.

Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you via email (to the address associated with your account) and update the effective date at the top of this page. Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of those changes.

We encourage you to review these Terms periodically. If you disagree with revised Terms, your sole remedy is to discontinue use and close your account.
